Phm vi iu chnh Ngh quyt ny quy nh v loi  th, nguyn tc phn loi  th; tiu ch, tiu chun phn loi  th; thm quyn cng nhn loi  th v t chc thc hin. iu 2. Mc ch, nguyn tc phn loi  th 1. Mc ch phn loi  th: a) Phn loi  th l c s  t chc, qun l, pht trin h thng  th quc gia, vng, tnh, qun l n v hnh chnh  th; nh gi vic thc hin theo quy hoch  th. Cc tiu ch, tiu chun phn loi  th l c s d bo, nh hng pht trin h thng  th v tng  th; b) Xy dng chng trnh, k hoch pht trin  th, t chc pht trin  th, phn b ngun lc v hoch nh chnh sch pht trin  th; c) Duy tr v pht trin h thng h tng k thut, h tng x hi, khng gian  th. 2. Nguyn tc phn loi  th: a) Phn loi  th c thc hin trn c s quy hoch  th, h thng  th c nh hng ti quy hoch c cp c thm quyn ph duyt, bo m cc xu hng pht trin  th thch ng vi bin i kh hu, xanh, thng minh, hin i v bn vng theo tng giai on pht trin kinh t - x hi, bo m quc phng, an ninh, c bit l i vi cc  th c ng bin gii, c khu; b) Phn loi  th c thc hin thng qua nh gi thc trng pht trin  th theo cc tiu ch, tiu chun phn loi  th quy nh i vi tng i tng, ph hp vi m hnh t chc chnh quyn a phng 02 cp v c p dng theo vng, min, yu t c trng; c)  th,  th mi t tiu ch i vi loi  th no th c cng nhn theo loi  th ; n v hnh chnh cp x c u t xy dng t trnh  pht trin  th i vi mc quy nh no th c cng nhn theo mc quy nh . iu 3. Loi  th 1.  th loi c bit l  th trung tm tng hp quc gia, quc t, c vai tr, v tr v iu kin pht trin kinh t - x hi c bit. 2.  th loi I l  th trung tm quc gia, c vai tr, v tr, chc nng trung tm tng hp ca quc gia. 3.  th loi II l  th trung tm tnh, thnh ph, c vai tr, v tr, chc nng trung tm tng hp hoc trung tm chuyn ngnh ca tnh, thnh ph hoc vng lin tnh. 4.  th loi III l  th trung tm tiu vng thuc tnh, thnh ph, c vai tr, v tr, chc nng trung tm tng hp hoc chuyn ngnh ca tiu vng. Chng II TIU CH PHN LOI  TH iu 4. Tiu ch, tiu chun phn loi  th 1. Tiu ch phn loi  th gm: a) Vai tr, v tr v iu kin pht trin kinh t - x hi; b) Mc   th ha; c) Trnh  pht trin h tng v t chc khng gian  th. 2. Tiu chun c th ha cc tiu ch phn loi  th i vi  th loi I c quy nh ti Ph lc I ban hnh km theo Ngh quyt ny, i vi  th loi II, loi III c quy nh ti Ph lc II ban hnh km theo Ngh quyt ny. 3. nh gi phn loi  th c thc hin theo phng php i chiu thc trng pht trin  th ph hp vi quy hoch  th vi cc tiu ch, tiu chun ca loi  th tng ng. iu 5. nh gi phn loi  th loi c bit, loi I 1. Khng t chc nh gi phn loi li  th loi c bit theo phm vi ton thnh ph i vi Th  H Ni, Thnh ph H Ch Minh. Cc  th thuc Th  H Ni, Thnh ph H Ch Minh c thc hin phn loi theo  th loi II, loi III theo quy nh ca Ngh quyt ny. 2. nh gi phn loi  th loi I: a) Phn loi  th loi I c nh gi theo cc tiu ch, tiu chun quy nh ti Ph lc I ban hnh km theo Ngh quyt ny theo phm vi c xc nh ph hp vi quy hoch  th. Cc  th thuc  th loi I c thc hin phn loi theo  th loi II, loi III theo quy nh ca Ngh quyt ny; b) Trng hp thc hin phn loi  th mi t tiu ch  th loi I th phi ng thi r sot, bo m cc  th loi II trc thuc p ng quy nh ca Ngh quyt ny. iu 6. nh gi phn loi  th loi II, loi III 1. Phn loi  th loi II, loi III c nh gi theo cc tiu ch, tiu chun quy nh ti Ph lc II ban hnh km theo Ngh quyt ny theo phm vi c xc nh ph hp vi quy hoch  th, 2. nh gi phn loi  th loi II, loi III: a)  th c phm vi ranh gii trong 01 n v hnh chnh cp x th thc hin nh gi trn phm vi ton  th theo cc tiu ch, tiu chun quy nh ti Ph lc II ban hnh km theo Ngh quyt ny i vi loi  th tng ng; b)  th c phm vi ranh gii nhiu hn 01 n v hnh chnh cp x th thc hin nh gi trn phm vi ton  th theo cc tiu ch, tiu chun quy nh ti Bng 2A Ph lc II v nh gi tng n v hnh chnh theo Bng 2B Ph lc II ban hnh km theo Ngh quyt ny i vi loi  th tng ng. 3. c khu c nh gi phn loi l  th loi II,  th loi III theo quy hoch  th. iu 7. nh gi trnh  pht trin  th i vi n v hnh chnh cp x trong  th,  th mi 1. n v hnh chnh cp x trong  th,  th mi c nh gi trnh  pht trin  th theo cc mc quy nh khi thc hin phn loi  th. n v hnh chnh cp x trong  th  c cng nhn loi  th c th thc hin nh gi c lp  c cng nhn trnh  pht trin  th  mc cao hn. 2. n v hnh chnh cp x c cng nhn trnh  pht trin  th theo mc t c i vi mc quy nh ti Bng 2B Ph lc II ban hnh km theo Ngh quyt ny. iu 8. p dng tiu ch, tiu chun phn loi  th 1. p dng tiu ch, tiu chun phn loi  th theo phn vng kinh t - x hi c thc hin nh sau: a)  th thuc vng ng bng sng Hng, vng ng Nam B th cc tiu ch, tiu chun phn loi  th thc hin theo quy nh i vi loi  th tng ng; b)  th thuc vng Trung du v min ni pha Bc th mc ti thiu ca tiu chun quy m dn s bng 60% mc quy nh; mc ti thiu ca tiu chun mt  dn s bnh qun trn din tch t nhin bng 50% mc quy nh; cc tiu ch, tiu chun khc thc hin theo quy nh i vi loi  th tng ng; c)  th thuc vng Bc Trung B, vng duyn hi Nam Trung B v Ty Nguyn th i vi khu vc trung du, min ni v cao nguyn p dng theo quy nh ti im b khon ny; cc khu vc cn li th mc ti thiu ca tiu chun quy m dn s bng 80% mc quy nh; mc ti thiu ca tiu chun mt  dn s bnh qun trn din tch t nhin bng 70% mc quy nh; cc tiu ch, tiu chun khc thc hin theo quy nh i vi loi  th tng ng; d)  th thuc vng ng bng sng Cu Long th mc ti thiu ca tiu chun quy m dn s bng 70% mc quy nh; mc ti thiu ca tiu chun mt  dn s bnh qun trn din tch t nhin bng 50% mc quy nh; cc tiu ch, tiu chun khc thc hin theo quy nh i vi loi  th tng ng. 2. p dng tiu ch, tiu chun phn loi  th c yu t c trng c thc hin nh sau: a)  th c ng bin gii quc gia trn t lin th mc ti thiu ca cc tiu chun quy m dn s, mt  dn s bnh qun trn din tch t nhin v mt  dn s tnh trn din tch t xy dng  th i vi n v hnh chnh cp x trong  th bng 50% mc quy nh; mc ti thiu ca cc tiu chun khc quy nh ti Bng 2A, Bng 2B Ph lc II ban hnh km theo Ngh quyt ny bng 70% mc quy nh ca loi  th tng ng; b)  th l c khu  c quy hoch l  th th mc ti thiu ca tiu ch mc   th ha quy nh ti Bng 2A, Bng 2B, tiu ch vai tr, v tr v iu kin pht trin kinh t - x hi quy nh ti Bng 2B bng 20% mc quy nh; mc ti thiu ca cc tiu chun khc quy nh ti Bng 2A, Bng 2B Ph lc II ban hnh km theo Ngh quyt ny bng 50% mc quy nh ca loi  th tng ng; c)  th loi III trn a bn cc n v hnh chnh cp x thuc danh sch cc n v hnh chnh cp x c c quan c thm quyn cng b l min ni th mc ti thiu ca cc tiu chun quy m dn s, mt  dn s bnh qun trn din tch t nhin v mt  dn s tnh trn din tch t xy dng  th i vi n v hnh chnh cp x trong  th bng 50% mc quy nh; mc ti thiu ca cc tiu chun khc quy nh ti Bng 2A, Bng 2B Ph lc II ban hnh km theo Ngh quyt ny bng 70% mc quy nh ca loi  th tng ng; d)  th,  th mi v cc  th trc thuc  bo tn, pht huy gi tr c sc c  v di sn vn ha vt th  c T chc Gio dc, Khoa hc v Vn ha ca Lin Hp quc (UNESCO) cng nhn th khng xem xt tiu chun mt  dn s bnh qun trn din tch t nhin v tiu chun mt  dn s tnh trn din tch t xy dng  th i vi n v hnh chnh cp x trong  th; trng hp  th loi I th c gim s lng cc tiu chun c nh gi mc  t theo quy nh ti Ph lc I ban hnh km theo Ngh quyt ny; trng hp  th loi II, loi III th cc tiu chun v khng gian, kin trc, cnh quan  th thc hin theo quy nh i vi loi  th tng ng, mc ti thiu ca cc tiu chun khc bng 50% mc quy nh ca loi  th tng ng. 3. Ch p dng mt trong cc quy nh ti khon 1 v khon 2 iu ny  nh gi cc tiu ch, tiu chun khi thc hin phn loi  th i vi  th,  th mi, n v hnh chnh cp x trong  th v p dng khi tiu chun cha t mc ti thiu theo quy nh. iu 9. nh gi tiu ch, tiu chun phn loi  th 1. Cc tiu ch phn loi  th c xc nh bng cc tiu chun c th, theo mc  t, khng t hoc c tnh im theo khung im phn loi  th theo quy nh ca Ngh quyt ny. im ca mi tiu ch l tng s im ca cc tiu chun ca tiu ch , tng s im ti a ca cc tiu ch l 100 im. 2. nh mc, phn b v phng php tnh im, phng php thu thp, tnh ton s liu ca tng tiu chun ca cc tiu ch phn loi  th, trnh  pht trin  th c quy nh ti cc Ph lc ban hnh km theo Ngh quyt ny. 3. Mc yu cu ti thiu: a)  th loi I phi c ti thiu l 12 tiu chun t theo quy nh ti Ph lc I ban hnh km theo Ngh quyt ny, trong : tiu ch vai tr, v tr v iu kin pht trin kinh t - x hi t ti thiu l 05 tiu chun; tiu ch mc   th ha t ti thiu l 03 tiu chun; tiu ch trnh  pht trin h tng v t chc khng gian  th t ti thiu l 04 tiu chun. i vi  th loi I c p dng tiu ch, tiu chun c th quy nh ti im d khon 2 iu 8 ca Ngh quyt ny phi c ti thiu l 10 tiu chun t theo quy nh ti Ph lc I ban hnh km theo Ngh quyt ny, trong : tiu ch vai tr, v tr v iu kin pht trin kinh t - x hi t ti thiu l 04 tiu chun; tiu ch mc   th ha t ti thiu l 02 tiu chun; tiu ch trnh  pht trin h tng v t chc khng gian  th t ti thiu l 04 tiu chun; b)  th loi II, loi III phi t ti thiu l 75 im ca cc tiu ch quy nh ti Bng 2A v cc tiu ch phi t im ti thiu tr ln; c im trung bnh kt qu nh gi i vi cc n v hnh chnh cp x theo tiu ch quy nh ti mc III Bng 2B t ti thiu l 48 im; c t nht l 01 n v hnh chnh cp x t ti thiu l 75 im v cc tiu ch phi t im ti thiu tr ln ca loi  th tng ng quy nh ti Bng 2B Ph lc II ban hnh km theo Ngh quyt ny; c) n v hnh chnh cp x c nh gi t trnh  pht trin  th khi c cc tiu ch t im ti thiu v tng s im ca cc tiu ch t ti thiu l 75 im ca loi  th tng ng quy nh ti Bng 2B Ph lc II ban hnh km theo Ngh quyt ny. 4. Cch tnh im ca cc tiu chun c quy nh nh sau: a) S liu, thng tin lm cn c  xc nh mc  p ng tiu chun t mc ti a th tiu chun  c tnh im ti a, t mc ti thiu c tnh im ti thiu, t gia mc ti a v mc ti thiu c tnh im ni suy gia cn trn v cn di, t di mc quy nh ti thiu th khng tnh im. Trng hp khng xem xt tiu chun quy nh ti im d khon 2 iu 8 ca Ngh quyt ny th tnh im ti thiu cho cc tiu chun . Trng hp c tiu chun cha t mc ti thiu theo quy nh ti Ph lc II ban hnh km theo Ngh quyt ny nhng c p dng t l gim % i vi mc ti thiu ca cc tiu chun theo quy nh ti iu 8 ca Ngh quyt ny th tnh mc im ti thiu cho tiu chun ; b) Trng hp p dng phn loi  th quy nh ti khon 2 iu 8 ca Ngh quyt ny m tiu chun c n v tnh l cng trnh, c s, d n (gi chung l cng trnh) quy nh mc ti thiu l 01 cng trnh th c tnh im ti thiu i vi tiu chun  khi c 01 cng trnh; trng hp quy nh mc ti thiu l t 02 cng trnh tr ln th s cng trnh dng  tnh im ti thiu c gim tng ng theo t l v lm trn s nhng khng c t hn 01 cng trnh. Chng III THM QUYN V T CHC THC HIN PHN LOI  TH iu 10. T chc lp v cng nhn loi  th, trnh  pht trin  th 1. Vic nh gi tiu ch, tiu chun phn loi  th, trnh  pht trin  th c tng hp trong  n cng nhn loi  th, bo co nh gi trnh  pht trin  th thc hin theo quy nh sau y: a) C quan chuyn mn thuc y ban Nhn dn cp tnh t chc lp  n phn loi  th loi I; trnh y ban Nhn dn cp tnh  trnh B Xy dng t chc thm nh, xem xt cng nhn; b) C quan chuyn mn thuc y ban Nhn dn cp tnh t chc lp  n phn loi  th loi II, loi III; trng hp  th c phm vi ranh gii trong 01 n v hnh chnh cp x th y ban Nhn dn cp x t chc lp  n phn loi  th.  n phn loi  th loi II, loi III phi c thm nh v trnh y ban Nhn dn cp tnh xem xt cng nhn; c) y ban Nhn dn cp x t chc lp bo co nh gi trnh  pht trin  th i vi n v hnh chnh cp x trong  th; gi c quan chuyn mn thuc y ban Nhn dn cp tnh  thm nh v trnh y ban Nhn dn cp tnh xem xt cng nhn. 2. Thm quyn cng nhn loi  th, trnh  pht trin  th: a) B trng B Xy dng quyt nh cng nhn  th loi I; b) Ch tch y ban Nhn dn cp tnh quyt nh cng nhn  th loi II, loi III v trnh  pht trin  th i vi n v hnh chnh cp x trong  th. 3. Kinh ph lp, thm nh  n cng nhn loi  th, bo co nh gi trnh  pht trin  th v cng b loi  th do ngn sch nh nc bo m v huy ng t cc ngun hp php khc. 4. Chnh ph quy nh chi tit trnh t, th tc lp, thm nh, cng nhn loi  th, trnh  pht trin  th v kinh ph thc hin cc ni dung quy nh ti khon 3 iu ny. iu 11. Pht trin  th theo tiu ch, tiu chun phn loi  th 1. Pht trin  th p ng cc tiu ch, tiu chun phn loi  th theo nh hng pht trin v c thc hin ng b t quy hoch  th, chng trnh pht trin  th, k hoch pht trin  th v t chc thc hin cc c ch chnh sch, nhim v, gii php pht trin  th. 2. Trn c s tiu ch, tiu chun phn loi  th, trnh  pht trin  th theo quy nh ca Ngh quyt ny, y ban Nhn dn cc cp thc hin cc quy nh sau y: a) Xy dng mi hoc b sung, iu chnh chng trnh pht trin  th ca tnh, thnh ph v k hoch pht trin  th ca cc n v hnh chnh cp x trong  th; b tr kinh ph  xy dng chng trnh pht trin  th, k hoch pht trin  th trn a bn; b) Xc nh cc ni dung v u t xy dng h tng k thut, h tng x hi v khng gian, kin trc, cnh quan  th  hon thin cc tiu ch, tiu chun phn loi  th; c) Xc nh cc yu cu, ni dung, nhim v, gii php t chc pht trin  th theo nh hng pht trin  th thch ng vi bin i kh hu, xanh, thng minh, hin i v bn vng; d) Phn cng c quan, n v thc hin trch nhim ca y ban Nhn dn cp tnh hon thin cc tiu chun v c s h tng  th, nht l h tng v y t, gio dc, o to v cng trnh vn ha cp  th v c quan, n v thc hin trch nhim ca y ban Nhn dn cp x hon thin tiu ch, tiu chun nh gi trnh  pht trin  th i vi n v hnh chnh cp x trong  th. 3. Chnh ph quy nh chi tit iu ny. iu 12. Chuyn i s trong phn loi  th 1. B Xy dng t chc trin khai thc hin thng nht trn ton quc vic chuyn i s trong phn loi  th v ng b vi cc hot ng pht trin khoa hc, cng ngh, i mi sng to v chuyn i s. 2. y ban Nhn dn cc cp: a) Thc hin trch nhim theo phn cng trong vic xy dng, qun l, khai thc v cp nht cc c s d liu phc v yu cu qun l, pht trin  th; b) Xy dng l trnh tng bc thc hin chuyn i s  theo di, nh gi, cng b cc tiu ch, tiu chun phn loi  th. iu 13. Trch nhim t chc thc hin phn loi  th 1. y ban Nhn dn cc cp c trch nhim: a) T chc lp chng trnh pht trin  th, k hoch pht trin  th, u t xy dng c s h tng  th ng b, nh k r sot, nh gi cht lng  th, cng khai cng b cc ch tiu pht trin  th cn t c theo tng giai on; b) y ban Nhn dn cp tnh cng b danh mc  th loi II, loi III, phng t mc quy nh trnh  pht trin  th i vi n v hnh chnh trong  th loi II, loi III c chuyn tip theo quy nh ti iu 15 ca Ngh quyt ny; c) y ban Nhn dn cc cp c trch nhim thc hin r sot cc tiu ch, tiu chun phn loi  th i vi cc trng hp c chuyn tip, lp, iu chnh, t chc thc hin chng trnh pht trin  th, k hoch pht trin  th v cc quy hoch, k hoch khc c lin quan bo m hon thin theo quy nh ca Ngh quyt ny. 2. B Xy dng c trch nhim: a) nh k t chc tng hp, nh gi tnh hnh phn loi  th v pht trin h thng  th quc gia, bo co Th tng Chnh ph; b) Thc hin cc nhim v khc do Chnh ph, Th tng Chnh ph giao. Chng IV IU KHON THI HNH iu 14. Hiu lc thi hnh 1. Ngh quyt ny c hiu lc thi hnh t ngy 01 thng 01 nm 2026. 2. Ngh quyt s 1210/2016/UBTVQH13 ngy 25 thng 5 nm 2016 ca y ban Thng v Quc hi v phn loi  th  c sa i, b sung mt S iu theo Ngh quyt s 26/2022/UBTVQH15 ngy 21 thng 9 nm 2022 ca y ban Thng v Quc hi ht hiu lc k t ngy Ngh quyt ny c hiu lc thi hnh. iu 15. iu khon chuyn tip Vic chuyn tip i vi kt qu phn loi  th trc ngy Ngh quyt ny c hiu lc thi hnh c thc hin nh sau: 1. Cc thnh ph Hi Phng, Hu,  Nng v Cn Th tip tc c xc nh l  th loi I theo quy nh ca Ngh quyt ny; 2.  th loi I, tr trng hp quy nh ti khon 1 iu ny,  th loi II, loi III, thnh ph Th c, khu vc cc phng thuc phm vi cc qun trc khi sp xp c xc nh l  th loi II theo quy nh ca Ngh quyt ny; 3.  th loi IV, loi V, th x v th trn trc khi sp xp cha c cng nhn loi  th c xc nh l  th loi III theo quy nh ca Ngh quyt ny; 4. Phng trong  th loi no th c xc nh t trnh  pht trin  th i vi n v hnh chnh trong  th loi ; 5. Phng trong  th loi I, loi II, phng thuc qun c sp xp vo thi im ngy 01 thng 7 nm 2025 m c thc hin nhp, iu chnh a gii vi n v hnh chnh nng thn th c xc nh t trnh  pht trin  th i vi n v hnh chnh trong  th loi III.
